Sex offender and partner stun neighbours with al fresco sex in communal garden

A man who was spotted by shocked neighbours having sex in a communal garden said he had just undone his trousers because he had a stomach ache.

Clive Weatherhogg was already on the Sex Offenders’ Register for a separate offence when he engaged in sexual intercourse with his partner Kirsty Jones in the shared garden of their home in Forfar, Scotland.

Neighbour Wendy McVicar told Forfar Sheriff Court that she had seen Weatherhogg, 49, with his trousers around his ankles and Jones, 34, completely naked on a bench in the garden.

Ms McVicar was taking in her washing when she caught sight of the pair: “[Jones] was lying on the bottom,” she said.

“Her legs were in the air and his bum was going up and down.”

In court, Jones maintained that she had been wearing a flesh-coloured bikini that may have given the appearance of her being naked from a distance, and that the pair had been merely “hugging”.

When she realised what was happening Ms McVicar called another neighbour, Irene McLean, to ask if she had spotted the al fresco sex too.

Mrs McLean told the court that after Ms McVicar called her she went to the window and the pair kept up a “running commentary” as it continued.

“She was lying down and he was lying on top of her,” Mrs McLean told the court. “I didn’t realise at the time but when she got up, she had nothing on. “

They were having sex – that’s the only conclusion I could come up with. “They were certainly locked together.”

Responding to a suggestion that Jones and Weatherhogg were just “cuddling,” Mrs McLean said: “I have never seen anybody hug anybody with b****cks shown,” then corrected herself…“buttocks shown,” adding “that is some hug, I tell you.”

Throughout the trial, Jones and Weatherhogg maintained that their activities in the garden on March 25 this year had been perfectly innocent but Sheriff Derek Reekie rejected their evidence and ordered reports ahead of sentencing on August 4.

At the time of the incident Weatherhogg was on the Sex Offenders Register relating to an earlier offence in which he had coerced a woman into having sex with a stranger in a hotel which he had recorded on video, sending the footage to the victim’s sister as her family sat down to Christmas dinner.

At the 2016 trial, the victim's father said the family was already "subdued" as it was their first Christmas since the death of his wife.

He said:"We were just about to sit down for our meal when one of my daughters got a text with the video.

"Some people didn't eat any Christmas dinner after that."
