A Boulder County jury found former Fairview High quarterback Aidan Atkinson not guilty Wednesday of sexual assault and attempted sexual assault in connection with a 2018 party bus incident.
The jury returned not guilty verdicts on two counts of sexual assault, one count of attempted sexual assault and two counts of unlawful sexual assault.
The foreperson told Boulder District Judge Patrick Butler that they were unable to reach a unanimous verdict on two other unlawful sexual contact charges, so Butler declared a mistrial on those counts.
Because prosecutors could choose to retry Atkinson on those charges, Butler kept Atkinson’s bond in place and asked attorneys to set Atkinson for a status conference to determine the next steps.
Atkinson also is still set for a separate five-day trial on two other counts related to sexual exploitation allegations that happened at a private residence three months after the alleged party bus incident.
Prosecutors alleged that Atkinson sexually assaulted two female students on a bus in 2018 that was transporting students celebrating Fairview High School’s homecoming.
Defense attorneys said Atkinson did not touch the girls under their dresses, as alleged, and that any dancing or kissing was consensual.
